Sometimes couples decide they would like to have an agreement similar to a prenuptial agreement, but they are already married. In those situations, the agreement is called a mid-nuptial agreement and it can cover all of the issues that a prenuptial agreement does. There must be consideration for the rights that either spouse may be giving up as part of the agreement terms.

Mid-nuptial agreements have become more common and are often prepared after a couple may have experienced a period of separation.
